Why Mursi
CHINA–U.S. COLLABORATION
EVIDENCE & DOCUMENTATION
INDEPENDENT LEGAL REVIEW
EB-1A · Extraordinary Ability
FIRST PREFERENCE
WHOLE FAMILY
-
法规原文 · 8 CFR § 204.5(h)(3)(i)
"Documentation of the alien's receipt of lesser nationally or internationally recognized prizes or awards for excellence in the field of endeavor;"
Regulatory Text · 8 CFR § 204.5(h)(3)(i)
"Documentation of the alien's receipt of lesser nationally or internationally recognized prizes or awards for excellence in the field of endeavor;"
In plain terms: documentation that you received nationally or internationally recognized prizes or awards for excellence in your field. "Lesser" means lesser than a one-time major international honor (a Nobel Prize, an Olympic medal) — not low-grade; the award must still carry national or international recognition.
What USCIS Looks For
- The award must honor excellence in your field — not participation prizes, shortlist mementos, or internal commendations.
- Officers weigh the granting body's authority, the geographic scope (national / international), and competitiveness (number of entrants, selection standards).
- Team awards can count, provided you are shown to be a recipient and the award relates to your own work.
- Common pitfall: a company award is not a personal award, and an award for a work is not an award about you — this criterion is about the person.
-
"Documentation of the alien's membership in associations in the field for which classification is sought, which require outstanding achievements of their members, as judged by recognized national or international experts in their disciplines or fields;"
Regulatory Text · 8 CFR § 204.5(h)(3)(ii)
"Documentation of the alien's membership in associations in the field for which classification is sought, which require outstanding achievements of their members, as judged by recognized national or international experts in their disciplines or fields;"
In plain terms: documentation of membership in associations in your field that require outstanding achievements of their members, as judged by recognized national or international experts in the field.
What USCIS Looks For
- The threshold is what matters: the membership level you hold must require outstanding achievement and expert review — pay-to-join membership does not qualify.
- Officers examine the bylaws and selection rules of your actual membership level, not a general description of the association.
- Membership held in a company's name generally cannot count as personal membership.
- Common pitfall: an officer title (director, vice-chair) is not a membership qualification — titles belong under Criterion 8; membership belongs here.
-
8 CFR § 204.5(h)(3)(iii)
"Published material about the alien in professional or major trade publications or other major media, relating to the alien's work in the field for which classification is sought. Such evidence shall include the title, date, and author of the material, and any necessary translation;"
Regulatory Text · 8 CFR § 204.5(h)(3)(iii)
"Published material about the alien in professional or major trade publications or other major media, relating to the alien's work in the field for which classification is sought. Such evidence shall include the title, date, and author of the material, and any necessary translation;"
In plain terms: published material about you, relating to your work in the field, in professional or major trade publications or other major media — each item with its title, date, and author, plus any necessary translation.
What USCIS Looks For
- You must be the subject, and the coverage must concern your work — pieces about your company or products alone are not enough.
- The outlet must be a professional publication, a major trade publication, or other major media — supported by circulation or audience data.
- Each item must identify its title, date, and author, and be submitted in full with translation.
- Common pitfall: news of a work winning an award (subject: the work) is not published material about you.
-
"Evidence of the alien's participation, either individually or on a panel, as a judge of the work of others in the same or an allied field of specification for which classification is sought;"
Regulatory Text · 8 CFR § 204.5(h)(3)(iv)
"Evidence of the alien's participation, either individually or on a panel, as a judge of the work of others in the same or an allied field of specification for which classification is sought;"
In plain terms: evidence that you participated, individually or on a panel, as a judge of the work of others in the same or an allied field.
What USCIS Looks For
- You must show judging actually performed, not merely an invitation or honorary listing: judging rules, records, and organizer confirmation all matter.
- The work judged must be in the same or an allied field.
- Journal peer review, competition juries, award panels, project review, and expert-pool review all count — itemize each.
- Common pitfall: an appointment letter with no record of actual service carries little weight.
-
"Evidence of the alien's original scientific, scholarly, artistic, athletic, or business-related contributions of major significance in the field;"
Regulatory Text · 8 CFR § 204.5(h)(3)(v)
"Evidence of the alien's original scientific, scholarly, artistic, athletic, or business-related contributions of major significance in the field;"
In plain terms: evidence of your original scientific, scholarly, artistic, athletic, or business-related contributions of major significance in the field.
What USCIS Looks For
- "Original" and "of major significance" must each be proven: a patent, a product, or a methodology does not by itself establish major significance.
- Let third-party evidence speak: adoption, citation, changed industry practice, measurable impact.
- Methodologies, theoretical frameworks, and pioneering projects can all be claimed — but articulate what is new and whom it affected.
- Common pitfall: listing achievements without impact, or self-assertion in place of independent corroboration.
-
"Evidence of the alien's authorship of scholarly articles in the field, in professional or major trade publications or other major media;"
Regulatory Text · 8 CFR § 204.5(h)(3)(vi)
"Evidence of the alien's authorship of scholarly articles in the field, in professional or major trade publications or other major media;"
In plain terms: evidence of your authorship of scholarly articles in the field, in professional or major trade publications or other major media.
What USCIS Looks For
- Four elements must hold together: you are the author; the article is scholarly; the venue qualifies; the topic is in your field.
- Promotional advertorials and company press releases are not scholarly articles.
- The regulation sets no threshold for number of articles, citations, or impact factor — but the more authoritative the venue, the stronger the evidence.
-
8 CFR § 204.5(h)(3)(vii)
"Evidence of the display of the alien's work in the field at artistic exhibitions or showcases;"
Regulatory Text · 8 CFR § 204.5(h)(3)(vii)
"Evidence of the display of the alien's work in the field at artistic exhibitions or showcases;"
In plain terms: evidence of the display of your work in the field at artistic exhibitions or showcases.
What USCIS Looks For
- Three things must be shown: the work is yours; it was actually displayed; the event is artistic in nature.
- Ordinary trade fairs and commercial expos cannot be placed here on the word "exhibition" alone.
- For applicants outside the arts, this criterion is usually not applicable.
-
8 CFR § 204.5(h)(3)(viii)
"Evidence that the alien has performed in a leading or critical role for organizations or establishments that have a distinguished reputation;"
Regulatory Text · 8 CFR § 204.5(h)(3)(viii)
"Evidence that the alien has performed in a leading or critical role for organizations or establishments that have a distinguished reputation;"
In plain terms: evidence that you performed in a leading or critical role for organizations or establishments that have a distinguished reputation.
What USCIS Looks For
- Both steps must stand: the organization has a distinguished reputation (an independent, third-party basis) and your role was leading or critical (duties plus results).
- A title is not enough — state what you directed, what you delivered, and what verifiable results followed.
- Your own company can be claimed, but scrutiny is stricter: prove both the company's reputation and your personal contribution.
- Common pitfall: filing only a business license or appointment letter, with nothing on reputation or personal impact.
-
"Evidence that the alien has commanded a high salary or other significantly high remuneration for services, in relation to others in the field; or"
Regulatory Text · 8 CFR § 204.5(h)(3)(ix)
"Evidence that the alien has commanded a high salary or other significantly high remuneration for services, in relation to others in the field; or"
In plain terms: evidence that you commanded a high salary or other significantly high remuneration for services, in relation to others in the field.
What USCIS Looks For
- Comparisons must be like-for-like: same occupation, region, and year, on a consistent basis (annual / monthly, pre- / post-tax).
- Only objectively documented income counts: tax records and bank statements are the strongest; untaxed "cash" portions should not be included.
- Business revenue, financing raised, and personal assets are not remuneration for services.
- There is no fixed dollar threshold — the point is being high relative to peers, expressed in multiples.
-
"Evidence of commercial successes in the performing arts, as shown by box office receipts or record, cassette, compact disk, or video sales."
Regulatory Text · 8 CFR § 204.5(h)(3)(x)
"Evidence of commercial successes in the performing arts, as shown by box office receipts or record, cassette, compact disk, or video sales."
In plain terms: evidence of commercial success in the performing arts, as shown by box office receipts or record, cassette, compact disk, or video sales.
What USCIS Looks For
- Performing arts only; the commercial results must tie to works you participated in.
- Figures need a verifiable source: box-office statistics, distributor or platform data, audit reports.
- Merely having works released or performed does not by itself establish commercial success.
- For applicants outside the performing arts, this criterion is not applicable.
